Please read these Terms of Service ("Terms," "Terms of Service") carefully before using the www.Holocia.com website (the "Service") operated by Holocia dba Citadels Inc. ("us," "we," or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

Payment and Billing:

  • Pricing: All prices are listed exclusive of applicable taxes. Taxes will be added at checkout.

  • Payment Methods: We accept major Credit or Debit Cards and PayPal.

  • Late Payment: We do not charge late fees for failed or late payments, however, orders are subject to cancellation if timely payment is not received. Automatic recurring billing is NOT required for subscription renewals.

Cancellation and Refunds:

  • Cancellation Policy: If you wish to cancel your subscription service, you must provide us with a required notice period of 30 days.

  • Refunds: Any requests for a refund on goods or services are subject to a 30-day notice requirement for eligibility for a partial refund if goods were involved.

 

4. Acceptable Use Policy

 

You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation.

  • To harass, abuse, or harm another person or entity.

  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.

  • To engage in illegal activities.

  • Our Content: The Service and its original content, features, and functionality are and will remain the exclusive property of Holocia dba Citadels Inc. and its licensors. This includes all text, images, logos, and recipes displayed on the Site, unless otherwise indicated. Our IP is protected by copyright, trademark, and other laws of both the United States and foreign countries.

  • User Content: By uploading, posting, or submitting content (including reviews, comments, or forum posts) to the Service, you grant Holocia a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute that content.

8. Governing Law and Dispute Resolution

 

Governing Law: These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Mandatory Arbitration and Venue:

  • Any legal claim or dispute arising out of or related to the Service, excluding small claims actions, shall be resolved exclusively through MANDATORY BINDING ARBITRATION administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

  • By agreeing to these Terms, you waive the right to a jury trial and the right to participate in a class action lawsuit.

  • The venue for any legal dispute, whether arbitration or litigation (if arbitration is deemed unenforceable), shall be exclusively in the courts of Travis County, Texas.

 

9. Changes to Terms

 

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
